France was found guilty for not transposing properly the 1990 Directive on environmental use of genetically modified organisms (GMOs).

ECJ 20 November 2003, nyr
Austria’s action challenging the distribution of ecopoints for 2001 was dismissed. Court stated that the ‘declaration principle’, according to which a journey can be counted as a transit journey solely on the basis of the setting of the ecotag when a heavy goods vehicle enters Austria has no foundation in Community rules.
*C-278/01, Commission v Spain
ECJ 25 November 2003, nyr
For the second time (after Greece) a financial penalty has been imposed on a Member State for not complying with an earlier judgement. Spain was ordered to pay what could amount to over euro 9m. The Court explains how exactly how it calculates this amount. In the earlier Court decision C-92/96 of February 1998, Spain was found guilty for not conforming to the limit values for inshore bathing waters set in the Bathing water directive.
